Terms of Service

1. Scope

These Terms of Service apply to all users of the web application "Cinematic AI" (hereinafter "Service"), operated by C&P Apps Michael Knochen Sole Proprietorship (hereinafter "we" or "us"). By registering and using the Service, you agree to these terms.

2. Service Description

Cinematic AI enables users to create videos from text inputs (prompts) and/or uploaded images using artificial intelligence. Using the Service requires the purchase of "Credits".

3. User Account and Credits

Using the Service requires creating a user account. You are responsible for keeping your login credentials confidential. Video creation is billed through a credit system. The cost of creating a video is displayed before starting the process. Once purchased, credits are non-refundable unless a video generation demonstrably fails due to a technical error on our part. In such cases, credits charged for that process are automatically refunded.

4. Intellectual Property and Usage Rights

Your Content: You warrant that you have all necessary rights (copyrights, trademark rights, personal rights) to the images you upload and texts you enter, and that this content does not violate applicable law.

Generated Videos: Subject to compliance with these terms, we grant you a worldwide, perpetual, non-exclusive, transferable license to use, reproduce, distribute, and publicly display the videos you generate for private and commercial purposes. Please note that AI-generated content may have similarities with other generated content. We cannot guarantee exclusivity of generated visual elements.

5. Prohibited Use and Content

It is strictly prohibited to use the Service to create content that:

• violates applicable German or international law.
• glorifies violence, is pornographic, hateful, discriminatory, or otherwise objectionable.
• infringes the rights of third parties (especially copyrights, trademark rights, and personal rights).
• contains misleading or harmful information (disinformation).
• is used to depict real persons in a degrading or harmful manner.

We reserve the right to suspend user accounts without warning for violations of these rules and to remove content.

6. Limitation of Liability

The Service is provided "as is" without warranty for any particular quality or availability. We are not liable for damages arising from the use of generated videos. Our liability is limited to intent and gross negligence.

7. Changes to Terms of Service

We reserve the right to change these Terms of Service at any time. We will notify you of material changes by email or by notice on our website. Your continued use of the Service after changes take effect constitutes acceptance.

8. Final Provisions

The law of the Federal Republic of Germany applies. Should individual provisions of these terms be invalid, the validity of the remaining provisions remains unaffected.
